Desafios e implicações jurídico-sociais da desinformação na era digital 110 ABSTRACT: This research analyzes the legal and social challenges of disinformation in the digital age. The central object is to understand how the phenomenonof disinformation, intensifiedby digital technologies, impacts democracy, public health, and institutional trust. The research problem lies in identifying the social and legal risks arising from the spread of false information, especially when manipulation is intentional. The investigated hypothesis is that the absence of adequate regulation and media literacy amplifies the harmful effects of disinformation, undermining fundamental rights. The general objective is to propose legal and social mechanisms capable of mitigating such effects. The specific objectives are: (i) to understand the contours of disinformation; (ii) to analyze its social impacts; (iii) to examine legal responses in Brazil and abroad. The methodology is qualitative, based on literature review, legislative analysis, and case studies. The results show that disinformation is a phenomenon structured by technological, political, and cultural factors, which generate from polarization to erosion of trust in public institutions. It concludes with the need for combined strategies: balanced regulation, platform self- regulation, media education, and strengthening of critical thinking. INTRODUÇÃO O advento da sociedade da informação transformou profundamente a forma como os indivíduos produzem, consomem e compartilham conteúdo. A internet e, sobretudo, as redes sociais, deram origem a um ecossistema comunicacional descentralizado, no qual qualquer pessoa pode atuar como produtora de informações. Esse cenário, embora democrático em aparência, trouxe consigo uma série de desafios estruturais, dentre os quais se destaca a propagação massiva da desinformação. Mais do que um fenômeno pontual, a desinformação deve ser entendida como prática sistemática, intencional e organizada, capaz de comprometer valores constitucionais, como a liberdade de expressão, o pluralismo político e o direito à informação de qualidade.
