ABSTRACT: This study’s object is the application of the Artificial Intelligence (AI) tools ChatGPT and Gemini for the analysis and mitigation of risks in service agreements. The research problem arises from the high rate of litigation and economic losses resulting from contractual flaws, questioning how AI can optimize the preventive identification of these vulnerabilities. The central hypothesis is that AI, used as an auxiliary tool under indispensable human supervision, can effectively identify the gaps that lead contracts to legal disputes, and that the quality of this analysis is directly influenced by the precision of the command (prompt) provided by the user. The general objective is to assess the practical potential of these technologies in identifying risks in litigated contracts. Specific objectives include: mapping recurring risks; analyzing the comparative performance of AIs; evaluating the tools’ reliability and limits; and understanding how the formulation of the input command impacts the quality of the output. The research adopts a qualitative, empirical, and documentary approach, based on the analysis of 12 to 20 contracts litigated at the TJRS in 2024, submitted to the AIs with simple and structured prompts. As expected research findings, it is projected to demonstrate the viability of AI as a support tool and to offer a guide of best practices for crafting effective prompts for contractual risk analysis.
