O método é dedutivo e comparativo, fundamentado em análise dogmática, revisão doutrinária e estudo de casos. Os resultados apontam que a exigência de autoria humana limita a proteção de criações puramente algorítmicas, tanto no direito autoral quanto no desenho industrial, e que soluções contratuais podemmitigar riscos no curto prazo. Discute-se, ainda, a necessidade de reforma legislativa e de programas de compliance para assegurar transparência, segurança jurídica e incentivo à inovação no uso da IA na indústria da moda. ABSTRACT: This article examines the legal implications of generative Artificial Intelligence (AI) in the fashion industry, with particular focus on copyright protection and industrial design registration of algorithmic creations. The central issue lies in determining authorship and ownership: can AI-generated works be protected under Brazilian law, and if so, who holds such rights—the developer, the operating user, or no one at all? The underlying hypothesis is that significant normative gaps exist in Brazilian legislation, which does not explicitly address works created without direct human intervention, thereby generating legal uncertainty. The general objective is to analyze the applicability of intellectual property norms to fashion creations produced with AI, proposing both legal and practical solutions. The specific objectives include: (i) reviewing the concepts of Fashion Law and AI; (ii) examining national and foreign legislation and case law; (iii) identifying regulatory risks; and (iv) suggesting contractual and legislative measures. The research adopts a deductive and comparative method, grounded in dogmatic analysis, doctrinal review, and the study of cases. The findings indicate that the requirement of human authorship limits the protection of purely algorithmic creations under both copyright and industrial design law, and that contractual arrangements may mitigate short-term risks. The discussion further emphasizes the need for legislative reform and AI compliance programs to ensure transparency, legal certainty, and incentives for innovation in the use of AI within the fashion industry.
