O método da pesquisa é qualitativo, de caráter jurídico-teórico e exploratório, desenvolvido a partir do método dedutivo e fundamentado em pesquisa bibliográfica multidisciplinar em fontes nacionais e estrangeiras. ABSTRACT: This study analyzes the adoption of digital governance practices in the corporate environment as a tool for enforcing workers’ right to disconnect in light of advances in information and communication technologies. The research question is to identify how digital governance can be used as a tool for enforcing the right to disconnect, considering the intense connectivity imposed by telematic media and its impacts on workers’ health, dignity, and well- being. The hypothesis guiding the investigation is based on the premise that, although the right to disconnect is not expressly provided for in the Brazilian Constitution or subconstitutional legislation, its substantive foundation is supported by the fundamental rights to health, leisure, and human dignity, and digital governance can provide effective mechanisms for its realization. The overall objective is to analyze how digital governance influences the effectiveness of workers’ right to disconnect. Specific objectives include: investigating the role of technologies as tools for intensifying labor control; assessing the physical, mental, and psychosocial risks arising from hyperconnectivity; and propose the adoption of digital governance tools that balance innovation and competitiveness with the preservation of workers’ health. The research method is qualitative, legal-theoretical, and exploratory, developed using the deductive method and based on multidisciplinary bibliographic research in national and international sources.
