ABSTRACT: This study investigates the limits of judicial reorganization for rural producers, especially in the context of asset commingling, in contrast with the principle of business preservation. Brazilian agribusiness is a key economic pillar, and judicial reorganization, established by Law No. 11,101/2005 and enhanced by Law No. 14,112/2020, aims to ensure the continuity of productive activities during times of crisis. However, the unique characteristics of rural activities and the frequent overlap between personal and business assets of rural producers generate conflicts with the necessary protection of creditors. The general objective is to analyze the intersections and tensions between these legal frameworks by examining theoretical foundations and case law, with particular focus on decisions by the Superior Court of Justice (STJ). The methodology employed is an in-depth literature review, analyzing key authors such as well as a documentary analysis of relevant legislation and rulings. Partial results indicate that although the principle of business preservation is a cornerstone, asset commingling severely limits the effectiveness of judicial reorganization, requiring clear criteria for its identification and application. The study concludes that there is a need to harmonize the preservation of productive activity with legal certainty for creditors, proposing the discussion of mechanisms to promote greater asset transparency in the rural sector.
