Novo processo administrativo sancionador da ANAC: avanços e imprecisões para implantação da regulação responsiva 240 ABSTRACT: This paper proposes an analysis of the impacts of responsive regulation on sanctioning procedure of ANAC. It investigates whether the responsive regulation project of ANAC is being implemented, and to what extent. To this end, the research focuses on the new resolutions issued by the agency, which, in an attempt to improve the constraint pyramid, instituted differentiated sanctions, such as warnings and the obligations to do or not to do. The specific objectives are to analyze responsive regulation, its application by ANAC, and the scope of the new administrative sanctioning exceptions instituted. Therefore, the methodology employed is based on the study of the resolutions that address the sanctioning procedure of ANAC, based on responsive regulation theory. At this point, the originality of the text stands out in examining the evolution of responsive regulation from the perspective of oversight and the application of sanctions by the agency. Finally, measures are suggested to improve the responsiveness of regulatory oversight to enable the effective application of the new sanctions. INTRODUÇÃO Na construção do Estado Regular, que busca editar regras econômicas para aomesmo tempo proteger o interesse público e garantir a continuidade e o crescimento do mercado, expandiu-se a ideia de uma regulação responsiva, a qual tem como meta maior participação do setor regulado na construção da conformidade, deixando o uso de medidas de comando e controle para um segundo momento quando não há colaboração ou contumaz descumprimento de regras. A regulação responsiva passa pela mudança de procedimento da fiscalização, com acompanhamento do particular e aplicação de medidas diferentes da mera pena pecuniária, mormente quando o particular mostrar comportamento virtuoso. Para ser responsiva, a regulação e a sua consequente fiscalização devem ter um maior arsenal de ferramentas para induzir o comportamento do setor regulado, não sendo suficiente simplesmente aplicar multas. Cabe incluir instrumentos intermediários ou diferenciados para induzir o comportamento do empreendimento para a conformidade regulatória, promovendo proatividade e orientação.
